Terms of Service
The ground rules for using our site and working with us.
Last updated: October 2026
1. About these terms
These terms apply to your use of this website and to the services TeraByte provides: websites, automation and NFC products. By using the site or engaging us you agree to them. A written proposal, quote or agreement for your project may add to or override these terms for that project.
2. Using this website
You agree not to:
- use the site unlawfully or to harm others;
- attempt to disrupt, probe or gain unauthorised access to the site or its systems;
- submit false, misleading or malicious content through our forms.
The site is provided “as is”. We work to keep it accurate and available but do not guarantee it will be uninterrupted or error-free.
3. Quotes and enquiries
Budget sliders, estimators and indicative figures on this site are guides only and are not binding offers. A project only begins once we have agreed scope and price in a written quote or proposal and any required deposit has been paid. Quotes are valid for the period stated on them.
4. Payment
- Fees, deposits and milestones are set out in your quote or proposal.
- Invoices are payable within the period stated on the invoice.
- We may pause work on overdue accounts, and may charge reasonable interest on late payments.
- Deposits are non-refundable once work has started, to the extent permitted by law.
- NFC products are made to order and are priced and shipped as quoted.
5. Your content and responsibilities
You must own, or have permission to use, all text, images, logos and other material you give us, and it must not infringe anyone's rights or break the law. You are responsible for giving us timely feedback and approvals; delays on your side may move delivery dates. You keep ownership of your content and grant us a licence to use it only to deliver your project.
6. Intellectual property
On full payment, you own the final deliverables created specifically for you, such as your custom website design and copy. Until payment is received in full, ownership stays with us.
We keep ownership of our pre-existing tools, code libraries, templates, mascot and branding, and of third-party components, which remain under their own licences. We may show finished work in our portfolio unless you ask us in writing not to.
7. Third-party services
Projects may depend on third-party platforms such as hosting, domains, payment providers, messaging and email services. They are governed by their own terms, and we are not responsible for their outages, price changes or policy changes.
8. Warranties and liability
We provide our services with reasonable skill and care. We do not guarantee specific business results, such as rankings, traffic, leads or sales.
To the extent permitted by law, TeraByte is not liable for indirect or consequential loss, including lost profit or data, and our total liability for any claim is limited to the fees you paid us for the service giving rise to it. Nothing in these terms excludes liability that cannot be excluded under law, including your rights under the Consumer Protection Act 68 of 2008 where it applies.
9. Cancellation and termination
Either party may end a project by written notice. You will pay for work completed and costs incurred up to that date. We may end or suspend services immediately if you breach these terms or the law.
10. Privacy
How we handle personal information is explained in our Privacy Policy.
11. Governing law and changes
These terms are governed by the laws of the Republic of South Africa, and the South African courts have jurisdiction over any dispute. We may update these terms from time to time; the version published here, with the date above, applies when you use the site.
